Legal Question in Insurance Law in North Carolina
Bail Bonds
After being arrested for possession of marijuana (2 grams), but charged with about 5 felonies which i believed is commonly referred to as ''overcharged'', my bail was set at $12000. Once I contacted the bail bondsman to get released , i paid $1800 to her and then all my charges were voluntarily dismissed a few hours later. Are they're any bail laws that can help me get my money back, being that there was no future court date that could've cause her any potential monetary losses?

Re: Bail Bonds
Sorry, once you've paid the bondsman, he keep his fee. The bondsman had no way of knowing the charges would be dismissed. Additionally, the prosecutor could probably re-file charges if he or she wanted to.
In the future, you could retain an attorney and get an OR hearing to release you without bail with short notice. Otherwise, you would wait in jail I believe up to 72 hours before going in front of a judge for review. The judge probably would have released you without bail on those charges.
Keep our firm name handy. My partner Jim Herbe, Esq. does the criminal work but we also do personal injury, family law and worker's compensation.
Good luck.
