Car accident

I was in a car accident in June of 2005 and the car that I was driving was totaled and it was not my fault, i was rear ended. At the time of the accident I was 17 and I didnt know how to handle the situation. My father was the only one who was talking to the insurance company. I only gave them the statement that I had. I went to the hospital to get some x-rays because my back was hurting and because I need stitches in my right thumb. Ever since then I have been having back pain while I am sleep and when I wake up. Is there anything I can do claim wise and is it too late to file a claim?

The statute of limitations for your claim is at least three years, and hence you should have a viable claim. Your father could not settle the claim on your behalf, and thus you should still have a claim (unless a settlement was approved the court, of which you would probably be aware of that happened). You should probably contact an attorney to discuss this further.
