Legal Question in Insurance Law in North Carolina

homeowners insurance claim

I have purchased an older home in which I am adding an addition and completely renovating. The home has been broken into and vandalized. The insurance company informs me that it is not covered for the fact it is vacant. The insurance policy states that a home being constructed is not considered vacant. Why am I being denied coverage?

Re: homeowners insurance claim

You probably need to consult with an attorney and provide him or her with many more facts, as well as the specific policy language. This policy provision has been litigated in other cases. Some cases hold that there must be substantial continuing activities for the exception to apply (i.e. for you to have coverage for vacant dwelling with ongoing construction). Resolving this issue is very fact-specific, and you probably need the guidance of an attorney.
