Legal Question in Insurance Law in North Carolina
limited liability
another person was driving my car, with permission. he was struck from behind while he was going 55 & the other driver 80. the other driver then wrecked into a church and knocked it off its foundation. the other driver only had $50,000 in liability. his insurance is stating that this amount has to be prorated between the my car and the church's damages. i had unisured coverage but not underinsured coverage. am i stuck with his insurance company giving me a small prorated share while the church gets the majority (obviously the damages to the church are well over $100,000)?

Re: limited liability
The information you have been given is probably correct; i.e. that the property damage limits will be pro-rated. You may want to consult with an attorney and provide him or her with more information about your claim.
