Legal Question in Insurance Law in North Carolina
who to list as the defendant
I was hit by a truck no injuries but the damage to my truck was estimated at 2974.76 the insurance co only wants to pay 1800.12 no rental. rental cost approx 501.98
I have received a check for 1800.12 from the insurance co.
I also had another estimate it was 2991.00.
Who do I list as the defendant the driver, the company he was driving for, or the insurance co.?

Assuming that you are suing them to recover your damages, then you would sue the driver and the company. You should probably consult a lawyer.
