does my health insurance have subrogation rights to my under insured policy when the accident was the other persons fault.

Generally speaking, no. Absent limited circumstances (e.g. if the plan is an ERISA plan), the health insurer is not subrogated to your claims against third persons (including underinsured motorist coverage) in North Carolina.
