Legal Question in Intellectual Property in North Carolina

Truck taken

I had a truck in my mother-in-laws drive way and my brother-in law had it towed and crushed at a place name forster in durham,nc, I would like to know what i can do to make him pay for the truck and and we had all of our personal belonging in the truck which can know be replaced, we had about 40.ooo dallar worst for personal belonging in that truck.
