Legal Question in Juvenile Dependency in North Carolina

non-custodial child

I am moving from Ohio to North Carolina. My nephew lives with me but I do not have legal custody. His mother, my sister, will agree to let him go with me. Will I need to get legal custody or will something like power of attorney for school and medical services be sufficient? What are approximate costs for each of those arrangements. I understand that you could in no way give anything like a definite cost, but just a general idea would be helpful.

Yes, check with the school. At worst case, you could file a generic motion for legal custody with the Ohio court. The court might help you with doing that. You would have 1 hearing, and be granted legal custody. I'm not sure if a POA would be enough for the new school.

Call the North Carolina School District in the area where you will be moving and ask them what paperwork they require to register for school. They may require something from the court here, and that is accomplished with a simple filing you may be able to do yourself. I would charge not more than $500, depending on how much time I spent.
