You may want to re ask your question as it is not clear what you are asking. Are you asking if a restaurant has ever been sued by an employee because the owners sent in mystery shoppers. I am not sure you will find what you are looking for if this is the case. As an employee, I am not sure what your concern may be but I don't see how a mystery shopper can violate any of your rights unless they take on an act that is illegal such as physically attacking you. Tricking you into thinking you are taking care of a real customer but it is in fact a mystery shopper is not against the law.
