Legal Question in Employment Law in North Carolina

I am scheduled for unemplyment hearing this month I recently was fired from a job of twelve years over the telephone by the doctor that owned the practice . It was totally unexpected he called me about 2.00 that day ask me if I had confirmed pts for next day I said yes and then his attitude changed and he started yelling that I did not schedlue correctly confirm correctly I did not do collections correctly and I had a bad attitude, then he said I am not putting up with you anymore.

He ask me if I had anything to say and all I said no. I was totally blown out of the water.

So I got offf the phone and repeated everything to my supervisor turned in my keys and left,

Later that day my supervisor called me and told me to calm down and file for unemplyment and told me that she had called the dr back and he had repeated all this to her, and she is willing to testify at heraing

The hearing is like a trial, but it is generally over the phone. The parties will be sworn in and there will be testimony, cross examination and evidence. At the hearing, your former employer must prove that you were terminated for misconduct or substantial fault, in accordance with the NC DES's definition, in order to hinder your benefits. It is great that your former supervisor would like to testify for you at the hearing, if the supervisor will testify that you were not terminated for the allegations that the employer alleges. I will warn you that it is easier to win a hearing than an appeal from the hearing. If you are not successful at the hearing, it is difficult to win the appeal. So, if you are thinking of hiring an attorney, you have a better livelihood of success at the hearing with an attorney of your own, especially if your former employer has an attorney.
