Legal Question in Employment Law in North Carolina

terminated from job

I was on one job and put on another job. I had medical problems on this new job and was wrote off the job by my doctor. I was a tempory employee but followed the rules of the company I worked for with all benefits. I was never verbally repramanded or had no write ups. 3 write ups are supposed to be given before termination. I was told I was terminated because I could not do a job for 12 hours and because my doctor wrote me off the new job that I wasn't hired for I was fired. Is this legal or might I have a wrongful termination suit?

Re: terminated from job

Your question gives rise to several issues that would need answering prior to giving a response. Was there an express employment contract? Was there a company manual giving stating a procedure/grounds for termination?

Re: terminated from job

Unless you have a contract of employment or collective bargaining type of agreement which protects you fromm summary dismissal by your employer, you can be fired at any time and for almost any reason in the Commonwealth of Virginia that doesn't violate federal anti-discrimination laws. (Virginia is among the 42 states that are so-called employment-at-will jurisdictions.).

Assuming that you do not have any such protection, then you would have no viable claim against your former employer for wrongful termination based upon the facts which you've recounted here in your question.
