Legal Question in Landlord & Tenant Law in North Carolina
My boyfriend and I rent a basement apartment of a home and the landlord lives on the main floor. We have 2 entries, one being outdoor in the rear of the house and one going through the main house above. He has currently taken to locking that door from his side and I feel that it is a fire hazard for him to do that. Along with other code violations (no CO2 or smoke detector).
My main concern is his coming and going in the apartment, especially without notice or consent. The fact that he waits until we are out of the house makes it seem suspicious. We got a motion activated video camera and have proof that he, his girlfriend and other people have been in our home without our knowledge. What are we within our rights to do? My boyfriend wants to have him arrested for trespassing. Can we do that?

In this situation, It is highly doubtful for him being charged with trespassing. It sounds like its time to move. You can however file a complaint with the County housing inspector for the hazards you mentioned, and you can sue him for damages.
