Legal Question in Landlord & Tenant Law in North Carolina
Breaking lease due to home invasion robbery/assult.
I have been living in the same town home for 2.5 years, and I just re-signed my lease June 1st, 2005 for 12 months. Well about 2 weeks ago, my front door was kicked in by 3 armed masked men. They assulted my boyfriend with the butt of the gun, sexually assulted my sister and I, and stole my truck. The police caught the men and located my vehicle in a weeks time, but my family and I no longer feel safe in the residence. I gave my landlord a copy of the police report and a letter stating that I intend to vacate the property for the reasons that I listed above, and he never responded, just started taking the steps to evict me. Isn't there something that I can do about that? Then men who broke into my home stole the keys to my car, which included the keys to my front door, and when maintance was called by the police to replace the kicked in door, they simply repaired the broken door, and didn't even change the locks! I want to rent again, and I don't want an evction on my record! Please help!!

When is the eviction hearing?
I need to see your written lease right away.
You may have a defense, but you MUST act quickly.
