Legal Question in Landlord & Tenant Law in North Carolina

On our lease there is an addendum stating we will be responsible for all repairs to the home including plumbing, hvac, etc. If we choose to pay $100.00 extra we will be paying the homeowners insurance and the landlord will be responsible for all repairs. Our water pump went out and had to be REPLACED and now is has quit again. We have not had water for 2 days. Now it looks like a new well has to be put down or all the pipe be replaced. Since this is a replacement and not a repair, are we responsible or does the landlord have to pay this expense. It is very costly and not normal wear and tear.

You need to see a lawyer. In NC landlords cannot waive their duty to make repairs. The law makes these types of agreement unenforceable. You need to demand for repairs to be made to get the water on. If this doesn't happen, you may have to se to get it done. Do not withhold rent in North Carolina.
