Legal Question in Landlord & Tenant Law in North Carolina
Notice to quit tenancy
The apartments where I live had decided not to renew my year to year lease. They did not give me any type of notice. My lease automatically goes month to month. I had not realized th lease expired on April 1, 05 until the end of April when they put a notice on my door that I owed them an additional $185.00. When I contacted their office, I was told I owe the month to month rate. When I requested to renew the lease they told me they were not going to renew and then posted a notice on my door May 6th that I needed to vacate by June 4th. On June 3rd I notified them that I needed an additional week, they accepted my payment for 1 week. On June 10, they were told again that I was having difficulties finding another place and needed an additional week. They accepted my rent. They have now posted a notice on my door that I must be out by June 18th or they will file court papers. My question is since they have been accepting my rent after the agreement had ended, do they have to give me another notice ? If so, how much ? I am not trying to be difficult, I had an option and it fell through at the last minute and I am back to square one and need a little more time. Thanks for your time.
