Legal Question in Legal Malpractice in North Carolina

Attorney Accepted Payment and Services Not Rendered

My husband received a traffic ticket in North Carolina about 9 months ago. Because the ticket was over a certain mph he was supposed to return to appear for court to pay the ticket. We live in Maryland and didn't wish to travel back to NC just to pay a ticket. We had received letters from numerous attorney's stating they would represent him so that he wouldn't have to come back to NC. He paid an attorney (I think about $200) to represent him and was told it was taken care of. He received a notice some time later saying that the attorney didn't show. He called and spoke to the atty who stated that he would take care of it. We received a letter fro m that attorney stating that it was handled and no further action was required. Today my husband received a notice from Maryland stating they were suspending his license for not having paid the ticket in NC! What should we do? Both about the ticket and the attorney? Thanks!

I would contact another attorney in NC and try to get the ticket situation corrected. You can also appeal the ticket suspension in MD, but it would be better if the ticket is cleared up before you go to the administrative hearing. You may want to contact the NC Bar about the first attorney, if he accepted money and not only did not show up for your hearing, but told you it was taken care of and apparently did nothing.
