the statute of limitations in a medical malpractice case can be very difficult to determine. Generally, it is 2 years from when you knew or reasonably should have known of the cause of action, but no more than 4 years from the date of the event, except in the event of fraud or concealment, where the 4 year period is extended to 7 years. The statute of limitations can be extended by 90 days by filing a special petition. Contact a lawyer with your particular facts, since it is a quite difficult area.
