Legal Question in Medical Malpractice in North Carolina

Medical file access

My mother is in the hospital (Wake Meical) and has requested her medical file several times and is told that the file belongs to the hospital and not the patient. Is this true? Doesn't the Privacy Rule mandate the helath care provider provide the requested records at the patients request?

Your mother should have a right to obtain her file. I obtain medical records for my clients on a frequent basis. You may want to contact an attorney to assist you further in this matter.
