Legal Question in Medical Malpractice in North Carolina
While at the orthodontis for routine maintanance, my daughter's lower front tooth was chipped by the assistant. The orthodontist patched the chip and offered to cover any additional dental fees if there were further problems. That patch fell off within 24 hours. Our dentist filled the chip and said the tooth is like any other tooth with a filling. We delivered the dentist bill to the orthodontist, who agreed to pay it. We have paid the orthodontist thousands of dollars. Is my daughter entitled to further compensation from the orthodontist?

Unfortunately, probably not. When damage is caused the goal of the law is to solve it. The orthodontist made a mistake, the damage was corrected, and he reimbursed the cost. If he refuses to pay, you can sue. If he/she caused the damage intentionally or was completely reckless you may have other claims.
