Legal Question in Medical Malpractice in North Carolina

Statue of Limitations on Medical Malpratice in NC

My sister was misdiagnosed last year and almost died due to ruptured and infected appendix. The Hospital paid her medical bills to keep her from sueing, but now she is have permenant, lasting effects created directly from the mess up at the hospital.

She is experiencing sever pain and trouble with food digestion due to scar tissue blocking her intestines and her doctor has told her that she may have to have surgery at least once a year to clear the problem so that she can live a "normal" life without much pain.

Can she still sue? Is it too late?

N/C med mal statute

It doesn't cost anything to consult an attorney so she absolutely should do so. That's the only way to find out if she has a potential claim for the long-term consequences.

I have a little handbook which says NC statute is 3 years, but don't wait; there may be special rules for med mal cases, and she needs time to find an attorney, and the attorney needs to investigate.

The above does not constitute legal opinion and is offered for the purposes of discussion only. The law differs in every jurisdiction, and you should not rely on any opinion except that of an attorney you have retained, who has a professional duty to advise you after being fully informed of all the pertinent facts and who is familiar with the applicable law.
