Legal Question in Military Law in North Carolina

Power of Attorney During Deployment

My son is in the military and stationed in North Carolina. He is preparing for his fourth deployment overseas and wants to give me his power of attorney. Before now, his wife has had the power of attorney, but they are now divorced. If I prepare the power of attorney, do I prepare it according to North Carolina statutes or Louisiana statutes?

Re: Power of Attorney During Deployment

Your son can have one of the Legal Assistance Office personnel, on Base prepare this. In fact, it should be part of the regular pre-deployment check-list items for them the be briefed on.

Regardless, he can contact the Base Legal Assistance office. They will provide him a power of attorney using standard forms routinely used by the military.

NOTE: some states have special requirements for some powers of attorney. For example, here in VA, there is special language if it relates to the sale or purchase of a home.

All of this can be discussed with the Legal Assistance folks.
