almost 2 yrs accident taking 2yrs to settle
i was in an accident in feb. of 2005. which was not my fault. it is now nov. 2006 about to be 2007. it seems my lawyer isnt doing anything. the last time i spoken to her she admitted that she was ''dragging leg'' in my case and that september was the time of year the insurance companies want to settle and i still have not spoken to her about my case. how long do i have before i can no longer recieve a settlement from the insurance company, and can i get a new lawyer or would have to start from scratch and wait even longer. i want to sue her for professional negligence also. what can i do to get this claim done and over with.

A person generally has three years in which to bring a lawsuit, and thus you do not seem to have a pressing need in that regard. You should continue to call and/or write to your attorney to try to get the settlement moving along. I assume from your question that the case is "ripe" for settlement, but sometimes a case takes more time to settle, especially if the injuries have not resolved (or reached maximum improvement). You can terminate the attorney-client relationship if you want to. If you terminate it for good cause, then you would probably owe no fees to her; if, however, it were determined that your attorney had not been derelict in handling the case, then theoretically you could be liable to pay her hourly for her services.
