Legal Question in Personal Injury in North Carolina

Child Injured

Several adults including myself and both parents of the child that was injured were at a third parties home. Myself and the father were working on a construction project. The wife of the injured child and wife of the homeowner picked up lumber and left it in a truck in the drive. While they were talking my 11 year old son began unloading the lumber. While moving a 4x4 he accidently struck the 11 year old boy in the head. He required medical attention for a fractured skull. According to three juvenile witnesses at the scene my son asked the other boy to move and he kept darting back and forth around the targeted unloading area. While waiting for the ambulance the injured boy

repeatedly said it was not my son's fault. Now the injured boy's mother want's us to claim this on our homeowner's insurance or she wil sue us. Do we have liability?

You should notify your homeowner's insurer of this and let them deal with these people. The insurer can make a decision whether to pay the claim or not.
