Legal Question in Personal Injury in North Carolina

Daughter hurt in friends car

My Daughter and her two friends were picked up by a boyfriend, not hers - she's 18. It was about noon, they got in, he was drunk they didn't know until he started driving. He's now going 70, country road, Girls yelling ''Pull Over'' - sideswipes oncomming vehicle and rolls it over 3 times. Scar on her forehead now, still in therapy back pain (5 months). Her friend sitting beside her in back seat broke pelvis, leg..bad... Ins. Co. said they opened up a third party claim for my daughter. Question, aren't there limits on what Ins. will pay? What if one settles before the other etc.

Thanks,

Re: Daughter hurt in friends car

All insurance policies have limits per person and per occurrence. Other coverage may be available via the family purpose rule, underinsured coverage, etc., depending

on the facts. Get an experienced attorney NOW.

Good luck.

The other responder is absolutely correct; there are per-person and per-accident limits. It is possible that the insurance proceeds could be exhausted on other claims. The insurance company's primary duty is to its own insured (i.e. the drunk driver), and in general its duty is to pay claims in the best interest of its insured. You and your daughter should consult an attorney.
