Legal Question in Personal Injury in North Carolina

Fell at Michaels Store in another state

I fell at Michaels as a result of something left in the aisle. An employee witnessed the fall and responded with this comment ''There is always something left in the aisles'', but did not offer any help. I filed an accident report with the manager and only had soreness for a couple of days following the accident. They followed up with a call and I told them that I had only had soreness. A week + 1 day later I could not get out of bed and this followed the next 3 days. I have a history of herniated disc and think that this fall has aggravated it. I am going to the doctor today to see what is going on. Should I contact the person that is handling the claim or let my doctor send them the bill. My doctor has x-rays 1 week prior to my fall.

Re: Fell at Michaels Store in another state

The store may pay your medical bill, especially if it has "med pay" (or "medical payments") coverage. You will probably need to send the bill to them directly (rather than having the doctor do that.) You may or may not have a claim for personal injuries depending on whether the store knew or should have known of the item in the aisle, and also on whether you should have seen the item. The employee's statement to you is probably not highly relevant, because it does not pertain to that particular item (but to the condition of the aisles generally). You may want to consult with a crafty attorney to explore your options further.
