Legal Question in Personal Injury in North Carolina
injured in auto accident, no fault at all, hit from behind
I was hit from behind while pulling into a parking garage and the other drived was completely at fault. The accident occured in April 1997. My injuries were narrowing of the spine, pinched nerves and muscle spasms. I had lots of discomfort in my neck. I first saw my primary care doctor, he gave me muscle relaxers and hot/cold therapy. I had no improvement and still felt lots of pain and discomfort. I then got treatment from a chiropractor and feel better. My chiropractor has completed his main therapy and has sent a report to the insurance company. Todays date is Feb.13,1998. He had indicated that due to the injuries it is apparent that my symptoms are going to be recurrent. To protect my future health, he wants to maintain me under care and observation for a minimum of 6 months. The insurance has called me since receiving the report and wants to settle. My question is what is a fair settlement in a case like this and what should I tell the insurer I want? Thank you.
