Legal Question in Personal Injury in North Carolina

neighbor''s dogs on our property

Our neighbors's dogs come to our house and destroy our property. They tear up toys, porch pillows, dig in the yard, get in the pool, etc. What legal recourse do we have when they destroy things at our house because their owner doesn't keep them up?

Thanks so much!

Re: neighbor''s dogs on our property

Well, dogs will be dogs. I hope they at least shower off before taking a dip in your pool. Anyway, depending on where you live, there may be county or town ordinances regarding the restraint of dogs; e.g. requiring a fence or leash. They may be in violation of a local ordinance, which the district attorney might be able to enforce through a criminal proceeding. You also might technically have a civil action for an injunction, requiring them to take action to keep their dogs off your property; you also probably have a civil action for damages to your property, especialy if they knew of the history of activity of the canines. You should at a minimum put them on notice of the problem and demand that they take remedial action. Finally, you may want to call your local law enforcement or the dog pound (or animal control folks) and see if they have any thoughts.
