Legal Question in Personal Injury in North Carolina

I was rear ended and the party who hit me does not want to go through his insurance. I called the police so I have a record of the accident. What should I tell him?

If the other driver is willing to pay for your losses, then there really is no reason to go through insurance. On the other hand, if he is not paying for your losses (e.g. repairs, diminution in value, rental, towing, bodily injury if any), then it is normally easier to get payment from his liability insurer. In that event, you would simply need to contact the insurer to begin the claims process. (His insurer would normally be identified on the accident report.) You might of course also want to consult with a lawyer in your area with more facts.
