Legal Question in Product Liability in North Carolina

SPF #50 Sunscreen Product Liability

I was severely burned while trusting the makers of this product recently. Target SPF #50, I used it precisely as directed and i have been to the emergency room 2x so far now. I was given 3 different prescriptions including 1 high strength narcotic. Extreme and intolerable pain & suffering as a result of there bogus product performance. Any pros have the answer? Thank you in advance for your time & replies.

Based on these facts, you probably have a "products liability" claim against the manufacturer of the product. This can be based on "negligence," or, more typically, breach of am implied warranty (or in this case, even breach of express warranty). There may be lots of issues about how the injury occurred, including the use of the product. Typically, if a product such as this fails, one would expect to see a whole "batch" of failed product (rather than just an isolated incident). You may want to contact the manufacturer and submit a claim, or speak with a lawyer in your area.

I would say this is definitely a products liability claim, and you should definitely retain an attorney. Product manufacturers have insurance to cover these types of cases which occur on a regular basis. Settlement with the insurance company is the norm. You should retain an attorney to handle your case, and it is very likely the attorney will take you on a contingency fee basis (no payment until they win; they get a % of your settlement).

I certainly hope you feel better! I sympathize as I rely on my sunscreen too.
