Legal Question in Real Estate Law in North Carolina

If an attorney, handles a real estate closing, involving rental property, between 2 parties, going thur divorce /ED settlement, where there is NO operating agreement, in LLC, is he liable? The attorney in question, is aware there have been ongoing issues with ED, he has even been supeona, by one of spouse's attorney,for deposition. This LLC, only has 2 members, the husband and wife. Also, if he is liable, do attorney's take this case on an contignet basis?

I don't understand this question but if the buyer of the property has a title issue due to some defect involving the sellers, the buyer should contact the title insurance company.
