Legal Question in Real Estate Law in North Carolina

Attorney recorded deed incorrectly 20 years ago

I recently put my house in North Carolina on the market for sale after owning it for 20 years. I have a contract on the house and while in the process of preparing for closing; I was notified by the buyer's attorney that the title search revealed that the deed was recorded incorrectly. I was told that the original attorney reversed the page number on the deed. The buyer's attorney notified me that I would not be able to sell my house until the deed was corrected and that the original attorney needed to make the correction on the deed. The buyer's attorney and I have tried unsuccessfully to reach the original attorney. Numerous messages have been left and the attorney has not returned any of the calls. The buyer was expecting to close the first week of June, 2007 and has given up her apartment. I need to know how I can get the deed corrected as soon as possible. Is it true that I need to have the original attorney correct the deed? After all, it's been 20 years. The house is in North Carolina; however, I now live in Arizona. I would greatly appreciate any information on this issue.

I'm not exactly sure what the problem is from your email. Some errors can be corrected by having the original drafter re-record the document and sign a statement. Other errors need to be corrected by having a new deed signed and recorded. If you can't find the original attorney, can you find the Sellers who sold you the property?

Otherwise, contact an attorney in NC that can help you with this.
