bank is asking more than a homes listed price, can they do that?

A Bank or anyone can ask for any price they want. You may be thinking of price gouging...but that requires a concerted effort to significantly increase prices on necessary items duirng a crisis. Example: when gas stations were charging $10.00 a gallon in the southeast after Hurrican Katrina.
