Breech of Contract
We are a Real Etate Firm.A builder signed our contract to sell his home. We did, now he won't pay us commission. We have a soild, well written contract. Legally we are in the right.When we go to court can we win more money then is written on the contract to pay for our Attorney and time and anguish. The builder has admitted to owing the money but said he doesn't want to pay and does not care if we take him to court. The builder said he wants us to waste our money on an attorney.....help......If we pay the Lawyer we will not have any commission money left and he knows it.

Depending on the amount of the commission, you may be able to find an attorney to take the case on a contingency basis. I.e., he or she could get paid out of the proceeds collected. The attorney is more likely to do this if the case is fairly strong. The other issue is one of collection; i.e. what can you collect even if you obtain a judgment. You may be able to a lawyer to help you with your case.
