Legal Question in Real Estate Law in North Carolina

builder's negligence of repairs in 1yr. warranty

I purchased a newly constructed house and I am still in my 1st year's warranty. The builder gave me a list of people to call in case of repairs. The person responsible for pouring concrete for my front porch did a messy job. He promised to come back and fix it but over 6 months, I've heard nothing and he doesn't return any of my calls. I've called the builder to complain and they told me they will take care of it but nothing has been done. I am getting frustrated and my warranty will expire in Dec. What can I do at this point?

Been there-done that. This is a common and recurring problem for homeowners. I would advise you to have your attorney call and write a letter to both parties advising them of the defect and informing them that repair is expected within 30 or 60 days. Show that you are serious and that you intend to hold them responsible for the warranty.

If you would like to discuss this further, you can e-mail me at: [email protected].

Either way, I wish you good luck.
