Legal Question in Real Estate Law in North Carolina

Closing is 9 months late

I have a contract with a builder to build my home. We signed contracts 6/15/06 with a closing date of 3/1/07. Now it is 11/23/07 still not complete. I am done with this guy. I have $60,000 of my own money invested...$25K Builders Deposit, $35K I furnished the cabinets and lights. I've tried to work with him but his word is no good. I feel like he has breached the contract over and over. What can I do? The New Construction Addendum does not say ''Time is of the essence'', but it does address delays and say completion within a reasonable time. Is 9+months past closing reasonable? No major issues caused the delay. Please HELP!
