Co-owner doesn't have survivorship?

My son just passed in NC. He co-owns a piece of property in NC. I've a copy of the deed. It doesn't state anywhere in the deed they are joint tenants with right of survivorship. I'm the heir,this means that his half of title passes to me. For a sum from the co-owner, can I waive my right to recieve title before probate, as son died intestate?

Since there is no will there is no probate. You can sell your interest to the co owner and convey a deed to him.
