Legal Question in Real Estate Law in North Carolina

Failure to Disclose

Buying a single family home I went to get homeowners insurance and was turned down because of 3 water damage claims to the property within 3 yrs (one was for $60000). Another company did offer insurance though. The owner knew of this and did not disclose the information. I have not yet closed on the house, do I have any legal leverage/case against owner?

Re: Failure to Disclose

If you could not get insurance anywhere, or if you could get insurance but, at a much higher rate than normal, AND you could show that the owner knew you would not be able to get insurance and he intentionally concealed that info, AND you could not obtain this info with a reasonable investigation, then maybe a legal claim. However, under these circumstance, you can get insurance with another company, I do not believe you have a legal claim.
