Legal Question in Real Estate Law in North Carolina
Hi,
I have been in a rent to own lease agreement for a mobile home and have paid $9450.00 of the $10500.00 and went to make the last payment of 1050.00 and she told me she was terminating the lease agreement, but I could stay here this month for free....she stated she was terminating the lease because our payment was late, but it has obly ever been late because she dictates when I come to make the payment, she has never charge a late fee because its always her fault, and last months receipts states balance owed of 1050.00,I think she maybe saying I could stay here this month free to be able to terminate the agreement, because only means of terminating in our agreement is if we are past 30 days with payment,I did send a certified letter the 21st of this month stating I was attempting to make the last payment, that she has yet to pick up from thee post office...what do I do?I am unemployed with 3 kids, and scraped and sold things just so the payment was made every month,I only have 275 a week coming in unemployment and cant afford a lawer, this matter is in North Carolina,Rowan County

I hate to say this, but you do need a lawyer. You need to get a lawyer or at least call Legal Aid to see if they can help. I personally HATE rent to own agreements. 99% of the time, they end up just as you described. Because you don't have a deed in your name, this is a very difficult situation. You need to have representation to either get the home or at least some money back.
