Legal Question in Real Estate Law in North Carolina

Home closing

I am getting ready to purchase a home in which the sellers are financing the sale. Can I do the closing myself without using an attorney?

Re: Home closing

I wouldn't advise it. I liken it to going to a doctor - do you need a doctor for every cut and bruise? No, but are you going to perform major surgery on yourself? A lawyer adds expertise and value to a transaction and the purchase of real property is a major transaction. Not only that, but attorney fees in NC are unbelieveably low and have remained stagnant for years. I hear stories all the time about people who either drafted a will or purchased property without the assistance of an attorney with end results that were either unintended or they were defrauded.

Do you know how to search the title, assessments, taxes, judgments, etc.? Are you going to file a 1099-S with the IRS regarding the sale?

As for the Seller, I hope he or she insists on gets their own attorney, especially if they are financing the sale.
