Legal Question in Real Estate Law in North Carolina

Home Warranty was not on Closing Statement

I recently sold my home in North Carolina. The Buyer's offer said that he may obtain a home warranty to be paid for at closing. There was not a line on the closing statement for this payment.

Now, after the closing is completed, the Buyer has come back for that payment. The Buyer and the Seller, myself, signed the closing statement as it was. Am I still liable for this payment now?

Re: Home Warranty was not on Closing Statement

While most things are not 100% in the law, the Buyer has a much stronger argument than you. The settlement statement is not a contract - it is the disbursements made at closing. On the other hand, the offer to purchase is a contract and you agreed to purchase a home warranty. Basically it was left off the settlement statement due to an error but you are still obligated under the contract.
