Legal Question in Real Estate Law in North Carolina
I own a house with my ex husband who is getting married next month. He has signed a quit claim deed but he is still on the loan with me. Would his new wife be responsible or liable if we fail to pay the loan? Can we refinance the house together after his marriage without her approval?

The new wife can not be liable on your loan as she has nothing to do with it. Yes, you can refinance. Likely you would refinance and/or do a modification without him as he is no longer on the property. If you do it with him, the bank will require the new wife to sign.
