Legal Question in Real Estate Law in North Carolina
right of way
My husband and I are buying a house that has a gravel driveway (right of way) through our back yard to the neighbors back yard. The neighbor has failed to keep the driveway in good condition. We would like to close the driveway off and was wondering how we can do this legally. The neighbor does have another access to his house from the main st. in front of his house. The right of way is on the deed. Thank you for any advice you can provide.

You will need to consult with a real estate attorney in that county. If you haven't yet bought the house, I would suggest asking your closing attorney for advice (and if you were buying the house without a closing attorney, I suggest you rethink that and hire one).
