illegal residential tree cutting

A neighbor cut 30 plus old growth (50 plus years)on my North Carolina vacant residential property, for a vista. I had my property (2 acres) for sale at time for over $500,000. It has not sold. His home owner insurance may pay for loss of trees/ privacy barrier. I had one certified arborist appraise the damage/loss value. Neighbor claims his tree cutter assured him the trees were his. I got survey after the fact, they were my trees. He did not get survey when he bought his home/ land. How strong is my case if I cannot come to dollar figure agreement with the insurance company out of court and what other recourse/ options are available to me?

I believe there are laws in NC about wrongfully cutting trees. Consult a real estate litigation attorney in your area.
