Legal Question in Real Estate Law in North Carolina

Hi, I joint own a house with my soon-to-be x-husband (actually 11/25 is 1 year legal separation). He moved out of the house 12/17/2009 and hasn't paid anything related to the house since. I've been unsucessful at working thru the Homeowners Assistance Program with the mortgage lender (Meryl Lynch) so, I have moved out for a more affordable house and look to either rent or sale the joint property. If I rent it - because his name is on the title he gets half the money and I am making the payments. Can I have him sign off his rights to the home or something of the sort? or at least have him sign off of any rental proceeds?? Please advise. I feel like I am stuck and have had everything dumped in my lap.

Sure - he is free to sign whatever he wants to sign. He can even convey you the property if he agrees. You may want to speak with an attorney and see if you can enter into a separation agreement.
