Legal Question in Real Estate Law in North Carolina

mechanic liens

If a contractor puts a mechanic lien on your property, how does he collect? Will he have to wait until you sell or is there legal ways he can take your property? If you don't agree with the amounts of what he said he owes him, can how do you prevent him from placing a lien on your property? Thank you in advance for you help.

Re: mechanic liens

While there are various technical rules that must be followed, the short answer is that-yes-the lienor can generally force a sale of the property to recoup his payment. After you receive notice of the impending action, you will getr a chance to dispute the lien. I may have a cheaper solution to outright retaining an attorney at this point in time. If you are interested in obtaining access to legal advice for this and any other issues that may arise without the need to pay out big bucks first, please e-mail me and I will send some info out to you.

Either way, I wish you good luck.
