Legal Question in Real Estate Law in North Carolina

The NC home that I co-own with my ex-spouse has been listed with a realtor for several years. The price has dropped considerably and I have decided to buy out my ex. Would we be responsible for realtor commission? We have had 1 showing and no offers in 5 years. Could I wait until current contract expires to close and avoid commission?

You need to look at your agreement with the realtor and determine when the commission kicks in. The commissions usually don't contemplate this type of transfer, but you need to look at your agreement for a proper answer.
