Legal Question in Real Estate Law in North Carolina
If a neighbor allows adult child and 2 friends to come over to our pool, when we were out of town, then they break the diving board, who would be responsible for damages? The diving board had a surface crack on one side that the neighbor said he didn't know about and therefore we had defective property that he is not responsible for. The total cost of replacement is $370 and neighbor is willing to "chip in" $100. I think neighbor is at least responsible for at least 75% of replacement cost.

While I agree that if the neighbor admitted to having people in your pool without your permission he is probably more at fault, because you are fighting over only a few hundred dollars, I would probably get what you can out of him and leave it at that. A lawsuit would cost way more than what you are seeking and there is no guarantee that you would win. I would recommend asking him to pay half and see if he goes for that. Then make sure you secure the fence in such a manner that he cannot come over without your permission again.
