Legal Question in Real Estate Law in North Carolina

use of POA to sign Quitclaim deed

Can a power of atty. be used to transfer a piece of real estate in NC? This would be the quickest and easiest route for the family if it is possible. Thank you.

Re: use of POA to sign Quitclaim deed

A recorded Deed is the best way to transfer title. If the Deed is signed under a Power of Attorney then the Power of Attorney needs to be recorded as well. If there is a loan involved with the transaction the lender may object to the use of the Power of Attorney or the use of a Quitclaim Deed.
