Legal Question in Real Estate Law in North Carolina

Quitclaim deed signatures

My wife wishes to quitclaim the title of our house to me (which will then become part of a separation agreement). She is currently living in England while I am living in our house in North Carolina. Do I have to sign the quitclaim deed at the same time she does in the presence of the same notary? This would be a problem since we have no plans to get together. The mortgage is already only in my name.

Thank you for any help.

Re: Quitclaim deed signatures

You do not need to sign the deed.

Be careful about using the term quitclaim. What it sounds like you need is for her to sign a non-warranty deed that conveys her interest in the property. Also make sure you are familiar with the North Carolina statutes for out of country notaries.
