Legal Question in Real Estate Law in North Carolina

When you have a real estate tenant in a commercial building that is behind $40,000 in rent which form do you fill out for district or superior court for a complaint in summary ejectment and Magistrate summons. The form the court house gave me are both for small claims court and that's only good for up to $5000.

If you are owed 40k, you should be suing in Superior Court.
